Welcome to Local Marketplace (Pty) Ltd (“Local Marketplace”, “we”, “us”, or “our”). We operate the online platform available at https://localmarketplace.store, which connects buyers and independent vendors.

By using our website or services, you agree to these Terms & Conditions (“Terms”). Please read them carefully. If you do not agree, you may not use our platform.


2. Definitions

  • Buyer – any person who purchases goods or services through our platform.

  • Vendor – any individual or business that lists and sells goods or services through our platform.

  • Platform – our website, services, and related systems.

  • You/Your – a buyer, vendor, or user of our platform.


3. Accounts and Eligibility

  • You must be at least 18 years old to register an account.

  • Vendors must provide accurate and valid business or personal details during onboarding.

  • You are responsible for keeping your username and password secure.

  • You agree to provide true, complete, and current information when creating an account and when using our services.


4. Our Role

Local Marketplace provides the platform but does not own, manufacture, or supply the products sold by vendors.

  • Vendors are responsible for product descriptions, pricing, stock, warranties, and quality.

  • Buyers enter into a direct transaction with the vendor.

  • We are not a party to the sales contract between buyers and vendors.


5. Orders and Payments

  • Buyers can place orders through our platform. An order is only confirmed once payment is received.

  • Payments are processed securely through third-party payment gateways. We do not store card or banking details.

  • We reserve the right to cancel any order in cases of suspected fraud or breach of these Terms.

  • Vendors will receive payment after successful order confirmation, subject to any deductions (such as commission or transaction fees).


6. Delivery and Shipping

  • Vendors or appointed couriers are responsible for delivering products.

  • Delivery times may vary depending on the vendor and location. We cannot guarantee delivery dates.

  • Risk of loss or damage to goods passes to the buyer upon delivery.

7. Refunds and Returns

  • Buyers have rights under the Consumer Protection Act, 2008 (CPA).

  • Refunds and returns must be requested in line with our Refunds & Returns Policy [link].

  • Vendors are responsible for processing and honouring valid return and refund requests.


8. Vendor Responsibilities

Vendors agree to:

  • Provide accurate product information (description, images, price, availability).

  • Ensure all goods and services comply with the CPA, POPIA, and other applicable South African laws.

  • Handle after-sales service, warranties, and customer complaints fairly and lawfully.

  • Indemnify Local Marketplace against any claims, damages, or losses arising from their products or services.


9. Prohibited Use

You may not:

  • Use the platform for illegal or fraudulent activities.

  • Upload harmful, offensive, or misleading content.

  • Attempt to interfere with the operation or security of our platform.

  • Sell restricted or prohibited goods (e.g. counterfeit items, illegal products).

We may suspend or terminate accounts that breach these rules.


10. Intellectual Property

  • All content, design, logos, and branding on the platform belong to Local Marketplace.

  • Vendors retain ownership of their product listings but grant us a licence to display and promote their content on the platform.

  • You may not copy, reproduce, or misuse content without permission.


11. Limitation of Liability

  • We are not liable for products sold by vendors, delayed deliveries, or disputes between buyers and vendors.

  • Our liability to you (if any) will not exceed the value of the transaction in question.

  • We do not guarantee uninterrupted or error-free access to the platform.


12. Privacy

13. Changes to these Terms

We may update these Terms from time to time. Changes will be effective once published on the website. Your continued use of the platform means you accept the updated Terms.


14. Governing Law and Disputes

These Terms are governed by the laws of South Africa.
Any dispute must first be raised with us directly. If unresolved, disputes may be referred to a competent South African court with jurisdiction in the Western Cape.
